Robert Muir has over 25 years of experience in Real Estate Law; Real Estate Brokerage Law; Business and Real Estate Litigation, Arbitration and Mediation; and Real Estate and Business transactions.

Real Estate Matters: Muir often represents parties in lawsuits arbitrations and mediations on issues of breach of contract, fraud, disclosure, misrepresentation, mold, easements, encroachments, construction defects, commission and escrow disputes, professional negligence, CC&Rs, Department of Real Estate matters, landlord and tenant, foreclosure, financing, insurance issues, and real estate related matters.

Muir also advises buyers or sellers in residential and commercial sales and purchases, prepares documents, deeds for property sales or lease, financing, and advises real estate agents and offices on their rights and duties under agreements.

Business and Commercial Matters: Muir represents individuals, partnerships and corporations. Typical services include establishing corporations, limited liability companies, and general partnerships, advising on operations, preparing contracts on sale and purchase of businesses, and handling a wide range of business disputes and litigation, including breach of contract and fraud actions, collection of accounts, enforcement of judgments, and creditor representation.

Background

In 1981, Robert Muir began practicing law in San Diego. For 15 years, Muir practiced with an "AV Rated" five-attorney civil litigation, business and real estate law firm in downtown San Diego where he developed his own clientele and expertise.

Professional Activities

Muir served as an Arbitrator for the San Diego Superior Court (1994 - 2005) and American Arbitration Association (1988 - 1996) on business and commercial disputes. He was an instructor of contract law (1987 - 1990) and business law (1986 - 1987) at the University of California, San Diego Extension. He has made numerous presentations as keynote speaker and seminar panelist before professional groups including the San Diego Association of Realtors, San Diego Apartment Association, and San Diego County Bar Association, including appearances on radio. Muir has also given presentations on mediation to mediators at the National Conflict Resolution Center (formerly San Diego Mediation Center) and San Diego County Bar Association.

Muir has written 25 legal articles which have appeared in San Diego Lawyer (formerly Dicta of the SD County Bar Assoc.), Orange County Bar Journal, San Diego Realtor, Rental Owner (S. D. Apartment Assoc.) and other professional publications. He is a past Chair (1987 and 1997) of the Realtor/Attorney Committee (a joint committee of the San Diego Association of Realtors (SDAR) and San Diego County Bar Assoc.). He is also a past Chair of the San Diego Apartment Association's (SDAA) Legal Council and has been a member of the Association since 1988. Muir also serves on the SDAR's Risk Management Committee (1992 - present), an appointed committee which develops real estate forms for use in San Diego County, and has been an Affiliate Member of SDAR since 1984. Muir is also a member of the California and San Diego County Bar Associations.

Muir served as an intern to a United States Senator in Washington, D.C.; the Office of County Counsel, San Diego; and Office of City Attorney, San Diego. Muir has also testified before a U.S. House of Representative Sub-Committee on an important real estate issue.

Education

Muir obtained his Bachelor's degree, with departmental High Honors, in 1975 and Master's degree in 1976 from the University of Hawaii. He completed his law degree at California Western School of Law in 1980, receiving the I.H. Prinz Medal Competition Award and American Jurisprudence Award.

In 1987, Muir completed the San Diego Inn of Court certificate program on Trial Advocacy (30 hours) and Evidence Workshop (14 hours).

In 2003, Muir completed Introductory Mediation Skills Training, a certificate program, through the San Diego Mediation Center (32 hours).

In 2007, Muir completed Trial By Masters presented by the American Board of Trial Advocates, San Diego Chapter (6.5 hours).
